You can
argue that electrical fire are primarily caused by three factors: too much
current\, too much resistance in the wrong place\, too much (and sometimes
too little) voltage. But it is important to realize the vast majority of
electrically caused fires (outside of appliances) can&rsquo\;t be determine
d simply by looking at the physical evidence. Location\, location\, locati
on or maybe we should say origin\, origin\, origin coupled with physical e
vidence is the key.

David Bridges - Challenges to E
xpert Qualifications\, Methodology and Opinions
\n
David
E. Bridges is a technically trained attorney in Meagher &\; Geer\, P.L
.L.P.'s Catastrophic Loss Practice Group. His practices focuses on complex
civil litigation\, including fires\, explosions\, fire protection system
failures\, product failures\, and other catastrophic losses and constructi
on-related incidents across the United States. His assignments include for
ensic investigations of first-property and other catastrophic losses\, inc
luding fires and explosions involving industrial\, commercial\, and reside
ntial facilities\, agricultural and other commercial equipment and motor v
ehicles\, and marine vessels. David brings the science and law together to
investigate these incidents and provide defense and recovery representati
on from the outset of the incident through trial. \;

During both criminal and civil litigation\, an expert&rsqu
o\;s qualifications\, methodology\, and/or opinions may be challenged. The
goal of the challenge is to exclude the expert and/or their opinions from
trial. These challenges may occur at a Daubert or Frye hearing or some ot
her motion to exclude the expert or their opinions/testimony. The conseque
nces of the exclusion could impact the case and the expert&rsquo\;s viabil
ity in the future. Not surprisingly\, counsel\, experts\, and Courts throu
ghout the country are making such expert-challenges a hot topic in the ind
ustry. This interactive block of instruction examines the framework for wh
ich such expert-specific challenges arise in both public- and private-sect
or fire and explosion cases\, litigators&rsquo\; arguments to advance them
\, the public- and private-sector experts&rsquo\; involvement in them\, an
d the Courts&rsquo\; analytical framework to resolve them. We will address
all of the participants&rsquo\; knowledge and application of the scientif
ic method. We also address guidelines and standards of care applicable to
public and private sector fire and explosion origin and cause investigatio
ns\, including National Fire Protection Association (&ldquo\;NFPA&rdquo\;)
1033\, Standard for the Professional Qualifications for Fire Investigator
(2021 Ed.)\, NFPA 921\, Guide for Fire and Explosion Investigations (2022
Ed.)\, and their abilities or inabilities to meet those guidelines and st
andards of care. We will also take participants through a whole host of pu
blic- and private-sector case studies to illustrate the Court&rsquo\;s dec
isions to admit\, exclude\, or limit expert testimony following the challe
nges in fire and explosion matters. \;

luding ventilation and its effect on the surrounding materials.
\n
There will be case reviews as well as discussion on the increased gas ap
pliance fires\, direct vent concerns\, open fireplaces in exterior locatio
ns\, modular fireplace construction and modifications\, as well as BTU rat
ing and heat release rate concerns in these hearth products. \;\
